Terms of Service
Last updated: [DATE] — Template, not legal advice.
1. Acceptance of these Terms
By creating an account or using Datemaxxing (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to create an account. By registering, you represent that you are 18+, that all information you provide is accurate, and that you are not barred from using dating services under applicable law.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Acceptable use
You agree not to:
- Impersonate any person, or create a profile that is not genuinely you;
- Upload photos of anyone other than yourself, or content that is illegal, sexually explicit, or infringes others' rights;
- Harass, threaten, or harm other users, on or off the Service;
- Use the Service for commercial solicitation, spam, or automated scraping;
- Attempt to circumvent security measures or access another user's account or data.
We may suspend or terminate accounts that violate these rules, and may use automated and manual review of reports (Section 8) to enforce them.
5. Your content
You retain ownership of the photos and messages you submit. By uploading a photo, you grant us a limited, revocable license to store, display it to other members as part of normal Service functionality, and — only if you separately opt in — send it to our AI vision provider solely to generate your PSL Score. You can remove any photo, and that license ends, at any time.
6. The "PSL Score" feature
The PSL Score is an optional, opt-in feature that uses a third-party AI model to generate a subjective 0-100 rating and short comment about a photo you choose to submit. It is entertainment only — not a scientific, psychological, medical, or professional assessment of your appearance or worth, and results may be inconsistent, inaccurate, or occasionally unavailable. We disclaim liability for any emotional or other impact of using this feature, to the maximum extent permitted by law.
7. No guarantee of matches, safety, or outcomes
Datemaxxing helps you discover and message other members; it does not guarantee matches, successful relationships, or the accuracy of other users' profiles. We do not currently perform criminal background checks or identity verification on members. You are solely responsible for your interactions with other users. Always meet new people in public places, tell a friend where you're going, and never send money to someone you have not met in person. Report any suspicious behavior immediately.
8. Reporting and blocking
You can block or report another user at any time from the chat screen. Reports are reviewed to enforce these Terms; we may suspend or remove accounts as a result.
9. Termination and data deletion
You may delete your account at any time from Profile → "Delete my account and all data". We may suspend or terminate your account for violating these Terms, at our discretion, with or without notice for serious violations (e.g. harassment, underage use, illegal content).
10. Intellectual property
The Service, its design, and underlying software are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, or reverse-engineer the Service except as permitted by law.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by applicable law. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, Datemaxxing will not be liable for indirect, incidental, special, or consequential damages, or for any conduct of other users, arising from your use of the Service. [This section requires jurisdiction-specific legal review — liability limitations are treated differently under EU consumer-protection law versus US law.]
13. Governing law and disputes
[Placeholder — select governing law and dispute-resolution mechanism with counsel. Note that mandatory consumer-protection rules of an EU user's country of residence may still apply regardless of a chosen governing law, and pre-dispute arbitration clauses are restricted or unenforceable in several contexts.]
14. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
